1. Description of the Service

Izi is a nutrition education app that helps you track glycemic load, macronutrients, and other dietary metrics. The Service provides personalized daily nutrition targets based on general dietary guidelines and information you choose to enter. All data you enter is stored locally on your device and is never transmitted to our servers.

2. Medical Disclaimer and Assumption of Risk

BY USING IZI, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THIS SECTION IN FULL. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

2.1 Not a Medical Device

Izi is a general wellness and nutrition education tool. It is not a medical device and has not been evaluated, cleared, or approved by the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any other regulatory or government body as a medical device, clinical decision support tool, or software as a medical device (SaMD).

2.2 Not Medical Advice

Nothing in the Service constitutes medical advice, medical diagnosis, or medical treatment. All content, nutrition targets, metrics, alerts, tips, and any other information provided through the Service are for general educational and informational purposes only. They do not replace, and must not be used as a substitute for, the advice of a qualified physician, registered dietitian, or other licensed healthcare professional.

2.3 No Disease Treatment or Prevention

Izi does not diagnose, treat, cure, mitigate, monitor, or prevent any disease, disorder, or health condition — including but not limited to type 2 diabetes, prediabetes, polycystic ovary syndrome (PCOS), metabolic syndrome, cardiovascular disease, obesity, or any other condition. Any personalization of nutrition targets based on information you enter is based solely on general published dietary guidelines and is not a clinical intervention.

2.4 Nutrition Targets Are Estimates Only

The daily targets and recommendations calculated by Izi are derived from publicly available general nutrition guidelines (such as those published by the American Diabetes Association, the World Health Organization, the USDA, and similar bodies). They are population-level estimates. They are not individualized medical recommendations. Nutritional needs vary significantly between individuals, and the same targets may be appropriate for one person and inappropriate for another.

2.5 Food Data Accuracy Not Guaranteed

Nutritional data displayed in the Service (glycemic index values, calorie counts, macronutrient data, and similar information) is sourced from publicly available food databases and may contain errors, omissions, or outdated values. We make no warranty as to the accuracy, completeness, or fitness for purpose of any nutritional data in the Service. You are solely responsible for verifying nutritional information, particularly if you have allergies, intolerances, or medical conditions that require precise dietary control.

2.6 Consult Your Healthcare Provider

Before making any changes to your diet based on information from Izi, consult a qualified healthcare provider — especially if you have or suspect you have a medical condition, are pregnant or breastfeeding, take prescription medications, or have any other health concern. Do not use Izi as the basis for any medical decision.

2.7 Do Not Delay Medical Care

Never delay seeking professional medical attention, ignore your doctor's advice, or discontinue prescribed treatment because of anything you have read, seen, or received through Izi.

2.8 Not Suitable for Clinical Glucose Management

Izi is not designed for and must not be used for managing Type 1 diabetes, calculating insulin doses, interpreting clinical blood glucose readings, or any other clinical glucose management purpose. Izi does not integrate with continuous glucose monitors (CGMs), glucometers, insulin pumps, or any medical devices.

2.9 Your Assumption of Risk

You use the Service entirely at your own risk. You acknowledge that dietary choices you make are your own decisions, that Izi is one informational input among many, and that you bear sole responsibility for the dietary decisions you make and their consequences for your health.

3. Your Data

All information you enter into Izi — including your food log, health conditions, body statistics, and nutrition targets — is stored exclusively on your device. We do not collect, transmit, or have access to this data. You are solely responsible for maintaining and backing up data on your device. We cannot recover data lost due to device failure, app deletion, or any other cause.

4. Intellectual Property

The Service and all content within it — including text, graphics, logos, software, and nutrition formulas — are owned by us or our licensors and protected by applicable intellectual property laws. You may use the Service for personal, non-commercial purposes only. You may not reverse-engineer, decompile, copy, or distribute any part of the Service.

5. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose.
• Make medical or clinical decisions based solely on the Service's outputs.
• Reverse-engineer, decompile, or disassemble the Service.
• Attempt to gain unauthorized access to the Service or its underlying systems.
• Use the Service in any way that could harm others.

6. Third-Party Services

The Service may integrate with or link to third-party services (including app stores, health platforms, analytics platforms). We do not control third-party services and are not responsible for their content or practices.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• Any warranty that the Service will be error-free, uninterrupted, or secure.
• Any warranty that nutritional data, glycemic load values, calorie estimates, or any other content in the Service is accurate, complete, or suitable for your individual situation.
• Any warranty that the Service will produce any particular health, dietary, or wellness outcome.
• Any warranty that the Service is appropriate for your specific health condition.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

We and our affiliates, directors, officers, employees, agents, and licensors will not be liable for any:

• Indirect, incidental, special, consequential, punitive, or exemplary damages of any kind.
• Damages for personal injury, bodily harm, or deterioration of health arising from use of or reliance on the Service.
• Damages arising from dietary decisions made in reliance on the Service.
• Damages arising from errors or omissions in nutritional data within the Service.
• Damages arising from loss of device data.
• Damages arising from your failure to seek or follow professional medical advice.

Our total aggregate liability for any claim arising from the Service will not exceed $5.

These limitations apply regardless of the legal theory under which the claim arises, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits our liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable mandatory law.

9. Indemnification

You agree to indemnify and hold harmless At Your Best Sp. z o.o., including our affiliates, officers, employees, contractors, and agents, from any claims, liabilities, damages, losses, and costs, including reasonable legal fees, arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

10. Modifications

We may modify the Service or these Terms at any time. We will provide notice of material changes via an in-app notice or on this page. Continued use of the Service following any changes constitutes your acceptance of the updated Terms.

11. Termination

We may suspend or discontinue the Service at any time. Your right to use the Service ends immediately if you violate these Terms. Sections 2, 7, 8, and 9 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Warsaw, Poland. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and you retain any mandatory rights granted to you by the laws of that country.

Class Action Waiver: To the extent permitted by applicable law, you waive any right to bring claims as a plaintiff or class member in any class or representative action.

13. Severability

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect.

14. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Service.
